The ninth circuit court has upheld a ban on deploying state troops in the Oregon city, after a recent legal decision.

Appeals Court Agrees to Rehear Case

The federal appeals court decided on this week that it would rehear the legal dispute concerning the president’s authority with an larger group of eleven justices. The judicial body also vacated a previous ruling from a smaller judicial group that had supported the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a protracted court case over whether the administration has the legal right and valid reason to send state military units in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the deployment effort was initiated in due to months of protests.

Differing Viewpoints

The federal government has argued that federal officials at the immigration center in south Portland were under attack, while local authorities assert that municipal police have command of the situation.

Contrary to descriptions of the city as “war ravaged”, locals have been sharing footage of lush hiking trails and a vibrant culinary culture, and organizing events such as an protest bicycle event against the increased military presence.

Court Proceedings

The appeals court decision came after a federal judge in the city issued two legal injunctions this month – one preventing the federal control of the state troops, and another prohibiting the deployment of any military personnel in the state, after efforts to circumvent the initial injunction by calling up troops from California.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – permitting command of state troops – but the second ruling remained in place, preventing the physical sending of the forces.

En Banc Review

The latest ruling means the matter will be heard “en banc” – with both rulings under review simultaneously – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the judicial system are working to hold this administration accountable. The constitution limits the president’s power, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the legal representative in a official comment.

“The judicial body is sending a definite signal: the president cannot dispatch the military into American urban areas without cause. We will continue defending Oregon’s laws, values, and sovereignty as this case progresses and our legal battle continues in the courts.”
